Katstale.com values collaboration and transparency. We believe in clarity so our designers and customers understand how we operate and the nature of our business.

  • All designs refined for Katstale.com become the legal property of Katstale.com once payment is accepted.
  • Refined means any design that has been edited, adjusted, or reworked at Katstale.com’s request. At Katstale.com, co‑creation refers to collaborative refinement of katstale.com original concepts, not shared authorship or joint ownership. 
  • By accepting payment, designers relinquish all rights to the work. Designs cannot be claimed, reused, or resold by the designer after delivery.
  • Designers may continue to use general skills, techniques, and creative methods developed during collaboration in future projects, but not the specific designs created for Katstale.com.
  • Any co‑creator logos or names displayed on products are acknowledgments of collaboration, not ownership. This act is voluntary. Logos are created by designers to show their support for Katstale.com, but they do not represent a contract or shared partnership.
  • Logos and products created under Katstale.com cannot be reproduced, copied, or redistributed without explicit permission.

    This restriction applies to the final Katstale.com design as a whole, not to any third‑party stock elements that may be used within it.

  • Katstale.com retains full creative and commercial rights to every design, while recognizing the contributions of designers.

Katstale.com Customer Disclaimer & Terms of Use

At Katstale.com, we value uniqueness and individuality. Each order is created as an original work, shaped by your input and collaboration. Our commitment is to ensure that every order represents a distinct creation, not a mass‑produced item. Collaborations are treated as creative agreements, and with that comes shared responsibility to respect the rights and integrity of each design. By completing an order, you acknowledge and agree to be bound by the following terms:

1. Ownership

All designs, products, and creative works remain the sole property of Katstale.com. An order does not transfer ownership of intellectual property rights, including but not limited to copyrights, trademarks, trade dress, and moral rights.

2. License of Use

For each order, customers are granted a personal, non‑exclusive, non‑transferable, non‑commercial license to wear, use, and enjoy the purchased order for the lifetime of the product, unless revoked due to misuse. No commercial exploitation is permitted.

3. Prohibition of Reproduction

Orders may not be reproduced, copied, distributed, or used to create derivative works without Katstale.com’s prior written consent.

4. Showcasing and Adaptation

Katstale.com reserves the right to:

  • Display collaborative orders for promotional or community inspiration purposes. By ordering, you consent to such display and waive any claims of privacy or publicity rights in connection with promotional use.
  • Create and resell substantially modified adaptations of collaborative orders.

Definition: “Substantially modified” means the adaptation incorporates new customer input and differs materially in style, motif, or composition. No adaptation will ever replicate or duplicate an original customer’s order. Each adaptation will remain distinct, ensuring the original purchaser’s version is preserved as unique.

5. Uniqueness Guarantee

  • Base Designs: While certain motifs or logos may recur, no personalized order will be duplicated for another customer.
  • Derived Orders: If an order is inspired by an existing one, Katstale.com will customize it to reflect the new customer’s individual taste, ensuring the original remains unique.

6. Standalone Designs

Standalone designs created solely by Katstale.com may be ordered “as is.” No modifications will be made.

7. Community Testimony

Testimonials, acknowledgments, or names shown on Katstale.com are shared voluntarily by customers or collaborators. They are expressions of support only and do not create any ownership, partnership, or commercial rights.

8. Governing Law and Jurisdiction

This disclaimer and all orders with Katstale.com shall be governed by and construed under the laws of the State of New York, USA, without regard to conflict‑of‑law principles. Exclusive jurisdiction shall lie in the state and federal courts located in New York County, New York. At Katstale.com’s sole discretion, disputes may alternatively be resolved through binding arbitration in New York. Katstale.com may enforce its rights in any jurisdiction where its orders are sold, shipped, or used.

9. Remedies

Any unauthorized reproduction, distribution, or misuse of Katstale.com orders constitutes infringement and may result in legal action, including injunctive relief, damages, recovery of attorney’s fees, and any other remedies available under applicable law, pursued in any competent court worldwide.

10. Customer Release of Rights

By placing an order with Katstale.com, you acknowledge that your order is for personal enjoyment only and that you do not acquire ownership, intellectual property, or creative rights in the design.

You irrevocably release and waive any claims to the order’s design or adaptations, including any moral rights of attribution or integrity, to the fullest extent permitted by law, except where such waiver is prohibited by mandatory local law.

Katstale.com retains full creative and commercial rights, including the right to adapt, display, and resell designs, provided that your personalized version remains unique and distinct, never replicated. This release applies only to design rights and does not limit your ownership of the physical product you purchase.

Plain English Layer

  • Katstale.com owns the designs. Each order is yours to enjoy personally, but not to claim ownership.
  • No copying or resale. Any reproduction requires our written permission.
  • We may showcase your order. If others are inspired, we’ll adapt their version—but never replicate yours.
  • Your order is one of a kind. Even if motifs repeat, your personalized version will never be duplicated.
  • Testimonials are voluntary. Sharing your words or name is optional and does not create ownership or partnership rights.
  • New York law applies. Disputes will be resolved in New York courts or arbitration, though we may enforce our rights anywhere our orders are sold.
  • We will protect our work. Misuse may lead to legal action, damages, and recovery of attorney’s fees.
  • You release all design rights. Ordering doesn’t give you ownership of the desig—it remains Katstale.com’s creation.
